1. About these terms

These terms form a contract between you and [COMPANY NAME] Ltd (company no. [COMPANY NUMBER]), trading as Nexcom, whose registered office is at [REGISTERED OFFICE ADDRESS] ("Nexcom", "we", "us"). By ordering or using any service, you agree to these terms, our Acceptable Use Policy, our Privacy Policy and, where it applies, our Service Level Agreement.

2. Who can order

The account holder must be at least 18 years old, or have a parent or guardian create and pay for the account. You must give accurate details. We may verify your identity and may refuse or cancel any order, including to prevent fraud. You’re responsible for everything that happens under your account, including actions by subusers you add.

3. Our services

We provide game server hosting with the resources described at the time of your order. You are responsible for your server’s configuration, mods, plugins and content, and for keeping your own copies of anything important.

4. Third-party games

Nexcom is not affiliated with or endorsed by the developers or publishers of the games we host. Hosting does not include a licence to any game. You and your players must own legitimate copies and follow each game’s own end-user licence agreement and server rules. Game updates are outside our control and can change or break server behaviour, mods or plugins. We will update our server software promptly but cannot guarantee compatibility.

5. Payment and renewal

Services are billed in advance in pounds sterling and renew automatically each period until cancelled. We send a reminder by email before each renewal. If an invoice is unpaid, we may suspend the service [3] days after the due date and delete it [14] days after the due date, after which data cannot be recovered.

6. Cancellation and refunds

You can cancel at any time from the client area, effective at the end of the current billing period. If you are a consumer, you may cancel within 14 days of your first order under the Consumer Contracts Regulations 2013. Because you ask us to start your server immediately, we will refund the amount for the unused part of that period. Otherwise, except where the law requires, payments are non-refundable.

7. Fair use and suspension

CPU and network capacity are shared fairly between customers. You must follow our Acceptable Use Policy. We may suspend or terminate services where we reasonably believe there is a breach, a security risk, an attack against or from your server, or legal exposure to us or others.

8. Backups and data

Backup tools are provided for your convenience. You are responsible for keeping copies of your data. We are not liable for loss or corruption of data.

9. Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data. Our total liability in any 12-month period is limited to the amount you paid us during that period.

10. Changes

We may update these terms and will give at least 30 days’ notice of material changes by email.

11. Governing law

These terms are governed by the law of England and Wales. If you are a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
